Renewal of the municipal register (PADRON)

  • EU nationals: They are generally required to confirm their residence every 2 or 5 years, depending on whether they are registered with the Central Register of Foreign Nationals.
  • Non-EU nationals with temporary residence: They are required to renew their residence permit every 2 years. British nationals who have been residents in Benitatxell since before Brexit need to renew their registration on the local register every 5 years.

The risk of automatic removal from the municipal register

According to the National Statistics Institute’s Resolution on the management of themunicipal register, local councils are obliged to keep their records up to date, which entitles them to remove you from the register if you do not confirm your residence periodically.

If the registration is not duly renewed, a letter in Spanish is sent to the persons concerned. If they do not reply, an ex officio investigation is opened; this is published in the Official Gazette of the Province of Alicante, and if there is still no response, the person is eventually removed from the register.

HEADS UP 

Registering for stays lasting less than 183 days a year does not mean that you are resident for tax purposes in Spain. Spanish law stipulates that each citizen may only be registered in a single municipality. If you live in several places, you must register as a resident in the place where you spend the most time each year.
