How to get the payment document of a traffic fine
You have
different ways to obtain a copy of your traffic fine
- Through the outstanding tax bills option on the Online
Office
- At Suma’s customer
helpline on 965 292 000.
- At
any Suma office.
Payment of a fine
The payment of the fine can be with the 50% reduction or with the full amount of the fine. It can only be paid with 50% during the 20 calendar days following the date of notification of the complaint.
There are
different situations:
- Payment with the fine
ticket. This form has a payment validity period of 20 calendar
days from the date of the report. If this period of time has elapsed and
the payment has not been made, you will have to go to any Suma office or
contact the call center at 965292000 to have a new payment document
issued, which will be called Notification of the fine (Notificación de
denuncia).
- Payment with the
document "Notification of the fine" with the reduced amount (50%
reduction): This document has a validity of 1 month from the date of the
initiation of the sanction procedure (this data is shown in the
notification).
- Payment with the
document "Notification of the fine" with the full amount (this
happens when no allegations have been presented). This document has a
specific expiration that will be detailed in the document.
- Payment with the
document "Notification of the sanction" with the full
amount. This document is always with the full amount, because the
reduction is only contemplated during the period of 20 calendar days from
the notification of the fine.
Fines not
paid during the procedure must be paid within 15 calendar days of the date on
which the sanction becomes final.
If the
notification is not paid within the deadlines, an enforcement procedure will be
in place to recover the amount due plus surcharges and other costs.
Deadline
to pay with the 50% reduction (This is known as the reduced procedure.)
Once the
offence has been notified, either by hand, by post, or by publication in the
gazette, there is a deadline of 20 CALENDAR DAYS to pay the fine with a
discount of 50%, as from the day after the notification date. Note that
if the fine is paid:
- The administrative procedure is
terminated.
- The administrative channel to
appeal is concluded.
- No allegations can be made, and
if they are made , they will be deemed not to have been made.
- No appeals can be made.
- Only an appeal to the Court of
Administrative Disputer can be presented.
- The sanction is firm from the
moment of payment.
What if
the fine is not paid or no allegations are made within 20 calendar days of
notification of the complaint?
If payment
is not made within the 50% reduction period or if it is not alleged within 20
calendar days following notification of the complaint, the consequences are:
- The notification of the
denunciation has the effect of a resolution.
- After 30 calendar days
following notification of the complaint, the sanction can be executed.
- The termination of the
procedure puts an end to the administrative procedure.
This only applies to:
- Slight
infringements.
- Serious infringements that do
not earn points.
- Serious and very serious
infringements that were notified at the time of the complaint.
Deadlines to submit allegations (This is called Ordinary Procedure)
Once the
offence has been notified, either by hand, by post or by the Gazette BOE; you
have 20 NATURAL DAYS from the day following the date of notification of the
complaint to make your allegations.
Contents of the allegations:
- Identification data of the
interested party (name, surname and NIF)
- If presented by the authorised
representative: Documentary evidence.
- Give details of the file (file
number or number of the report form or registration number of the vehicle)
- Facts,
motivated evidence.
- Signature of the interested
party.
Answer from the Administration:
- If the allegations provide new
or different data to that found by the complainant, and whenever deemed
necessary by the instructor, the police agent will be notified to report
within 15 calendar days.
- Once the investigation of the
procedure has been completed, the investigating body will submit the
proposed resolution to the competent body for sanctioning so that it can
issue the sanctioning resolution.
The
proposal shall only be sent to the interested party, so that he can make new
allegations within 15 calendar days, if other facts or other allegations and
evidence different from those put forward by the interested party have been
included in the proceedings or have been taken into account in the decision.
An appeal
may be lodged against the decision terminating the administrative procedure
within one month of notification of the decision, or it may be lodged directly
with the Court of Administrative Disputes (tribunal
contencioso-administrativo).
