Meeting of One Voice for Cumbre with the Chief of Police and Councillors 20 January 2025

The mayor, due to other commitments, could only attend the first 30 minutes of the meeting.

At the beginning José Garcia gives us some general information about the local police:

There are in total 15 officers working in 3 shifts (4 in the morning, 2 in the afternoon and 2 in the evening). If there are special events the shifts are reinforced according to the need. 

The police station has 2 official police cars, 1 camouflaged car, 2 motorbikes and 1 van with 2 mobile radars.

Speed limits and speed cameras

OVFC recognizes the importance of a holistic approach to traffic planning, as demonstrated by the mayor’s presentation a few days earlier, and calls for the same thoughtful approach for Cumbre del Sol.

The mayor agreed and stated that this process has already begun. A traffic control project and a mobility plan have been carried out in the town centre The mayor commented that the same is planned for the Cumbre del Sol. A study and a mobility plan would be necessary in order to be able to raise the current speed limits that the DGT introduced in 2021. From 2021 the speed limit on urban roads throughout Spain is 20 km/h on single carriageway and pavement roads and 30 km/h on single lane roads. This law is intended to ensure the safety of pedestrians because, according to studies, the possibility of a fatal collision is significantly reduced at low speeds. These limits are intended to reduce the risk and severity of accidents, as well as to improve the coexistence between vehicles and pedestrians. Cyclists have the same consideration as pedestrians. Benitachell is a cycling town and the ascent to Cumbre del Sol has a cycle lane. For this reason, the speed limit on this climb must be 30km/h. Increasing the speed of vehicles passing alongside the cycle lane means that cyclists can be thrown off balance.

At the south entrance in the Valle del Portet area, there are plans to set up some chicanes to reduce speed. The same could be done in Panorama on the Ctra Superior.

Some time ago cameras were installed on the main roads in Benitachell to study the volume of traffic. These cameras are located:

• At the entrance from Moraira
• At the entrance from Teulada
• On the way through the village
• On the ascent to Cumbre near the Restaurant Beniasia

At the moment only the first data on the number of cars passing through the town have been obtained. From 18.12. to 31.12. the camera on the Avda de Alicante detected 26.000 cars passing through the town. Next month a meeting will be held to evaluate the data from the other cameras.

Thanks to the cameras in Benitachell and Cumbre del Sol, thefts in Benitachell and Jávea  have been significantly reduced and 80% of thefts have been solved.

The average speed camera in Cumbre del Sol is now operational. Soon the police will also carry out speed checks on Cumbre del Sol with the two mobile radars. According to the law, citizens have to be informed about this. The aim of these controls is to raise awareness among residents, workers and visitors to respect the speed limits in force. 

OVFC points out that ‘shortcuts’ to avoid the speed cameras on the Ctra General have already been posted on Facebook and that there is concern about the effect on nearby areas such as Girasoles and Adelfas.

Foreign number plates

A few years ago, a campaign was carried out to control cars from the UK and Germany. Number plates, insurance and drivers' licenses were checked. In the case of German cars, the German MOT (TÜV) stickers were also checked. Many infringements were detected. At the moment the foreign number plates at the Cumbre del Sol are mainly from the Netherlands, Ukraine, Russia and Poland. And there are still a lot of cars from the UK and Germany. In a future campaign, the police will concentrate on checking cars with Dutch number plates. If a foreign car is detected that should have a Spanish number plate, it is taken to the municipal car depot, and the case is reported to customs.

OVFC suggests that the police and the municipality could carry out an information and awareness campaign on social media on this issue.

Roundabouts

OVFC suggests modifications for the small roundabouts on the Ctra Central (Vapf entrada Norte, Ctra Central/Hípica and Cala Moraig/Ctra Central) because at the moment these roundabouts allow driving without reducing the speed. José García explained that these roundabouts cannot be changed to guarantee the passage of buses, rubbish and fire trucks, but that this issue would also be dealt within the aforementioned mobility plan for Cumbre del Sol.

Parking prohibition on the entire Ctra Central

Currently many owners and residents who have houses on the Ctra Central are asking for the lifting of the parking prohibition that has been put in place some years ago on the whole Ctra Central. OVFC explains that their problem is that there is no other place to park for visitors, relatives, social workers and pool attendants etc.

José García replies that this parking ban is part of the mobility plan that was the base for the Cala Moraig project subsidised by the European Union. Furthermore, the width of the carriageway of the Ctra Central does not allow parking on the sides of the road.

OVFC asks about people with reduced mobility and with the corresponding permit who need to park on the Ctra Central. The Chief of Police replies that they can stop for a few minutes to get in or out of the vehicle and that, in principle, these people who stop for the minimum time necessary would not be fined. In this context he also comments that last year about 10 parking permits for people with reduced mobility that were being used fraudulently have been withdrawn.

The new ordinance on civic coexistence

This ordinance, which is very important both for citizens and for the police, contains a collection of rules of coexistence in different blocks, as well as the possible monetary sanctions that may be applied in some cases if they are not complied with.

The ordinance regulates all kinds of aspects, especially those that generate the most complaints or nuisances, such as noise pollution from building work or parties, animal excrement on the public streets, the lack of cleanliness of private plots, uncontrolled dumping of household goods and building materials and the depositing of rubbish bags in unsuitable places, such as in rubbish bins instead of containers.

Until now the police only had the municipal banns as a basis for action and it was a very complicated procedure. But the new ordinance defines all infringements and the corresponding fines. SUMA is responsible for the management and collection of the fines that are imposed within the context of this new ordinance.

The new ordinance will come into force in February. José Garcia assures us that all well-founded complaints from residents will be taken into account and action will be taken on the basis of the new ordinance. In the case of uncontrolled dumping, he suggests taking photos of the cars responsible with their number plates and calling the police immediately.

El alcalde por otros compromisos solo puede asistir durante los primeros 30 minutos a la reunión.

Al principio José Garcia nos da unos datos generales sobre la Policía Local:

Hay en total 15 agentes que trabajan en 3 turnos (4 por la mañana, 2 por la tarde y 2 por la noche). Si hay eventos especiales los turnos se refuerzan según la necesidad. 

La policía dispone de 2 coches de policía oficiales,1 coche camuflado, 2 motos y 1 furgoneta con 2 radares móviles.

Límites de velocidad y radares

OVFC reconoce la importancia de un enfoque global de la planificación del tráfico, como ha demostrado la presentación del alcalde unos días antes y pide el mismo enfoque reflexivo para Cumbre del Sol.

El alcalde se muestra de acuerdo y afirma que ya se ha iniciado ese proceso. En el casco urbano se han llevado a cabo un proyecto de control de tráfico y un plan de movilidad. El alcalde nos comenta que lo mismo está planeado para la Cumbre del Sol. Un estudio y un plan de movilidad serían necesarios para poder a lo mejor subir los límites actuales de velocidad que la DGT introdujo en el año 2021. Desde el 2021 el límite de velocidad en vías urbanas en toda España es de 20 km/h en vías que disponen de plataforma única de calzada y acera y de 30 km/h en vías de un único carril por sentido de circulación. Con esta ley se pretende garantizar la seguridad de los peatones porque según estudios la posibilidad de un atropello mortal se reduce significativamente con una velocidad baja. Estos límites buscan reducir el riesgo y la gravedad de los accidentes, así como mejorar la convivencia entre vehículos y peatones. Los ciclistas tienen la misma consideración que los peatones. Benitachell es ciudad ciclista y la subida a la Cumbre del Sol tiene un carril bici. Por esto el límite de velocidad en esta subida tiene que ser 30km/h. Aumentar la velocidad de los vehículos que pasan junto al carril bici implica que pueda hacer perder el equilibrio los ciclistas.

En la entrada Sur en la zona del Valle del Portet está previsto poner unas chicanes para reducir la velocidad. Lo mismo se podría hacer en Panorama en la Ctra Superior.

Hace algún tiempo se han puesto cámaras en las principales vías en Benitachell para hacer un estudio del volumen de tráfico. Estas cámaras están ubicadas:

• En la entrada desde Moraira
• En la entrada desde Teulada
• En el paso por el pueblo
• En la subida a Cumbre

De momento solo se han obtenido los primeros datos sobre el paso de coches por el pueblo. Del 18.12. al 31.12. la cámara en la Avda de Alicante detectó el paso de 26.000 coches. El mes que viene se va a tener una reunión para evaluar los datos de las otras cámaras.

Gracias a las cámaras en Benitachell y en Cumbre del Sol, en Benitachell y Jávea se han reducido de forma significativa los robos y se ha podido resolver un 80% de los robos.

El radar de tramo en Cumbre del Sol ya está operativo. Próximamente la policía también llevará a cabo controles de velocidad en Cumbre del Sol con los dos radares móviles. Según la ley, hay que informar a los ciudadanos sobre esto. El objetivo de estos controles es de concienciar a los residentes, trabajadores y visitante de respetar los límites vigentes de velocidad. 

OVFC indica que ya se han difundido en Facebook «atajos» para evitar los radares en la Ctra General y que existe preocupación por la afección a zonas cercanas como Girasoles y Adelfas.

Matrículas extranjeras

Hace algunos años se llevó a cabo una campaña de control de coches del Reino Unido y de Alemania. Se controlaron matrículas, seguros y los carnés de conducir de los conductores. En el caso de los coches alemanes también se controlaron las etiquetas de la ITV alemana (TÜV). Se detectaron muchas infracciones. En este momento las matrículas extranjeras en la Cumbre del Sol son principalmente de los Países Bajos, Ucrania, Rusia y Polonia. Y sigue habiendo también muchos coches del Reino Unido y de Alemania. En una próxima campaña la policía se va a concentrar en el control de los coches con matrícula de los Países Bajos. Si se detecta un coche extranjero que debería llevar una matrícula española, se lleva al depósito de coches municipal y se comunica el caso a aduanas.

OVFC sugiere que la policía y el Ayuntamiento podrían llevar a cabo una campaña de información y concienciación en los medios sociales sobre este tema.

Rotondas

OVFC sugiere modificaciones para las rotondas pequeñas en la Ctra Central (Vapf entrada Norte, Ctra Central/Hípica y Cala Moraig/Ctra Central) porque actualmente estas rotondas permiten circular sin reducir la velocidad. José García nos explica que no se pueden cambiar estas rotondas para garantizar el paso de autobuses y de los camiones de servicio de basura y bomberos, pero que este tema también se trataría en el ya mencionado plan de movilidad para Cumbre del Sol. 

Prohibición de aparcar en toda la Ctra Central

Actualmente muchos propietarios y residentes que tienen casas en la Ctra. Central piden que se levante la prohibición de aparcar que se ha puesto hace algunos años en toda la Ctra. Central. OVFC explica que su problema es que no hay ningún otro sitio donde aparcar para los visitantes, familiares, trabajadores sociales y encargados de las piscinas, etc.

José García nos contesta que esta prohibición de aparcar forma parte del plan de movilidad que fue la base para el proyecto de la Cala Moraig subvencionado por la Unión Europea. Además, el ancho de la calzada de la Ctra Central no permite poner parkings en los laterales. 

OVFC pregunta sobre las personas con movilidad reducida y con la tarjeta correspondiente que necesitan aparcar en la Ctra Central. El Jefe de Policia responde que pueden parar unos minutos para bajar o subir del vehículo y en un principio no se multaría a estas personas que paran el mínimo tiempo necesario. En este contexto también comenta que el año pasado se han retirado unas 10 tarjeta de estacionamiento para personas con movilidad reducida que se estaban usando de forma fraudulenta.

La nueva ordenanza de convivencia ciudadana

En esta ordenanza que es muy importante tanto para los ciudadanos como para la policía, vienen recogidas en diferentes bloques una recopilación de normas de convivencia, así como las posibles sanciones monetarias que se podrán aplicar en algunos casos si no se cumplen.

La ordenanza regula aspectos de toda índole, especialmente aquellos que más quejas o molestias generan, como por ejemplo la contaminación acústica por obras o por fiestas, los excrementos de animales en la vía pública, la falta de limpieza de parcelas privadas, los vertidos incontrolados de enseres y materiales de obra y la deposición de bolsas de basura en lugares no adecuados para ello, como en papeleras en vez de en contenedores.

Hasta ahora la policía solo tenía los bandos municipales como base para actuar y era un procedimiento muy complicado. Pero en la nueva ordenanza se definen todas las infracciones y las multas correspondientes. SUMA lleva la gestión y el cobro de las sanciones que se interpongan dentro del marco de esta nueva ordenanza.

La nueva ordenanza entrará en vigor en el mes de febrero. José Garcia nos asegura que se van a tener en cuenta todas las quejas fundadas de los residentes y se va a actuar basándose en la nueva ordenanza. En el caso de vertidos incontrolados, sugiere que se hagan fotos de los coches responsables con su matrícula y que se llame a la policía en el momento.
